Wrongful Death

The legal term "wrongful death" refers to a death caused by another person's fault. Examples of wrongful deaths include drunk drivers causing accidents that result in the death of another driver or a pharmaceutical drug that causes a patient to suffer a fatal heart attack.

Generally, the family members or beneficiaries of the deceased file the wrongful death claim to recover compensation to replace the income the deceased would have earned and provided for them.  Additionally, a wrongful death claim can request the following:

  • Expenses related to the death, such as medical and funeral costs;
  • Lost benefits resulting from the death, such as insurance payments;
  • Lost inheritance due to an untimely death;
  • Compensation for pain, suffering, or mental anguish experienced by the survivors of the deceased;
  • Compensation for loss of companionship, care, or protection; and
  • Punitive damages to punish offenders and deter them from harming others in the future.
